For the myDGNB platform offered by DGNB GmbH (‘DGNB’, ‘we’, ‘us’), in addition to the information set out in the General Terms and Conditions of Use, the following also applies:
Information concerning our internal complaints management system (Art. 20 DSA) and the possibility of out-of-court dispute settlement (Art. 21 DSA)
- Internal complaints management system:
If Users do not agree with a decision, they can lodge a complaint against the DGNB's decision free of charge via our internal complaints management system. Complaints can be lodged via email sent to dsa@dgnb.de within 6 months of receipt of the contested decision. If we require further information in order to process the complaint, complainants may be contacted by our staff. Complaints will be dealt with promptly, without discrimination, carefully and non-arbitrarily under the supervision of qualified personnel. Once we have reached a decision, the complainant will be informed immediately. Out-of-court dispute settlement before authorised out-of-court dispute settlement bodies:
For the settlement of disputes in connection with decisions made within the scope of our internal complaints management system, there is, among other things, the possibility of out-of-court dispute settlement before a so-called approved out-of-court dispute settlement body within the meaning of Art. 21 DSA. Approved out-of-court dispute settlement bodies are impartial and independent bodies expressly approved by the EU Member States, which have the capacity and expertise to examine disputes submitted to them. DGNB will cooperate with the out-of-court dispute settlement body within the scope of the legal requirements. However, DGNB is not bound by the decisions of the out-of-court dispute settlement body.Further details of any out-of-court dispute settlement will be provided to Users, if applicable, together with any appealable decisions.
The above information does not limit the rights of Users to assert their claims against DGNB in court.
